Mangochi First Grade Magistrate court sitting at Nkungulu in the area of Traditional Authority (T/A) Chimwala, on Monday convicted and sentenced Stambuli James, aged 44, to 10 years’ imprisonment with hard labor after the court found him guilty for defiling an 8-year-old girl.
The court learnt through Mangochi Police Station Prosecutor, Inspector Shadreck Wisiki that James committed the offence on 31st March, 2023, at Chinganga Village, T/A Chimwala in the district.
Appearing before Magistrate Roy Kakutu, James denied the accusations, saying he took the girl to assist him cooking food and this prompted the state to parade four witnesses who proved the case beyond reasonable doubt.
In submission, the state prosecutor told the court that despite James being first offender, defilement cases are rampant in the country, as such, courts should avoid showing mercy to the offenders and therefore prayed for stiffer penalty with maximum sentence of 168 months which is 14 years.
But in mitigation, James asked for court’s leniency saying he has a wife and seven children to look after.
When passing judgment, Magistrate Kakutu said the court will send the convict to prison because he is a threat to minors.
He therefore sentenced James to 10 years Imprisonment with hard labor starting from the day of conviction.
