Ntchisi First Grade Magistrate Court has convicted and sentenced 20-year-old Nyongani Maziro of Kapoloza village, Traditional Authority (TA) Kalumo to 8 years Imprisonment with Hard Labour (IHL) for defiling two girls aged 15 contrary to section 138 of the Penal Code.
The court heard from State Prosecutor, Sub Inspector James Ngupasya Muyila that the convict had, in January this year, proposed love to the first victim who accepted and that the two had since been having unprotected sex.
He further said in March the girl’s parents realized that she was pregnant and the two got married for two weeks before the district’s social welfare officers intervened to break up the marriage.
The court further heard that on 28th May the convict proposed love to another 15-year-old girl in the same village with whom he had been having unprotected sex with. The victim later realized she was pregnant and the matter was reported to social welfare officers who reported the case to the district’s police.
The convict pleaded guilty to the defilement charges and prayed for leniency saying he is a first offender.
However, state asked the court for stiffer sentence saying despite him being first offender such cases are on the increase in the district.
First Grade Magistrate Dorothy Kalua agreed with the state saying, the two girls were young and of school going age and that the convict was supposed to play a protective role. She then proceeded to hand him an 8-year custodial sentence for each count to run concurrently.
